The People’s National Convention (PNC) has petitioned the Electoral Commission to reinstate its flag bearer Dr Edward Mahama in the December 7 presidential race.
Dr Mahama and 12 others were disqualified from the race for various infractions which border on criminality. The EC has reported eight of them to the police for investigations and possible prosecution.
After its 48-hour ultimatum to the EC to reinstate Dr Mahama or face the party in court expired, the PNC has petitioned the election management body over the matter.
The petition letter dated 19th October, 2016 explained to the EC provided explanations to the issues the EC raised about their candidate’s nomination form which formed the basis for his disqualification.
The EC disqualified Dr Mahama for using two subscribers who had also subscribed to another presidential candidate, an act which was not acceptable according to the electoral laws. It also said Dr. Mahama did not have the requisite number of subscribers as prescribed by Regulation 7(2) (b) of CI 94.
But the PNC’s lawyer, Dr Raymond Atuguba, in a 30-point letter said aside from “breaching the clear provisions of the law in this matter, the EC went outside its convention and practices. It has always been the practice since 1992, for the EC Chair as returning officer for presidential elections, to go through the completed forms with the presidential candidates and afford them the opportunity to have same rectified prior to any possible disqualification.”
