An Abeka District Court presided over by Victoria Afua Guansah has set Monday, March 27 to rule on the application submitted by defence counsel praying the court to order the prosecution to release all documents and witness statements they intend to rely on to enable the accused to prepare his defence.
Augustine Asafo Adjei, counsel for Jihad Chaaban, the accused, today failed to continue with the cross examination of the star witness and victim Evelyn Boakye in the Marwako pepper attack trial.
Instead, he filed a fresh application seeking an order of the court directed at state prosecutors to furnish the defence team with all documents they intend to rely on for their prosecution.
The defence lawyer, moving his application, said the request, if granted, would aid in putting up a more informed defence for their client.
Chief Inspector Hanson Armah, the police prosecutor in the matter, vehemently opposed the application by the defence lawyer.
The judge subsequently ordered the prosecution to file its statement in opposition Friday, March 24. Both parties are expected to return to court at 1pm same day for determination of the latest twist to the Marwako trial.
Jihad Chaaban, a supervisor at Marwako Fast Food at Abelenkpe in Accra, is before court for allegedly dipping the face of Ms Boakye, a kitchen staffer, in pepper paste resulting in eye injuries.
