Justice Kwaku Ackaah Boafo of an Accra High Court has ordered Minister for the Interior Ambrose Dery to free Indian businessman Ashok Kumar Sivaram, who has been in state detention at the Airport for the past two days on claims that he entered the country without a visa after the same court quashed his deportation by the Minister.
The passport of Mr Kumar Sivaram, who re-entered the country on 2 August, is, however, to be seized by the state on the orders of the judge.
The Indian businessman has also been ordered by the court to the Ghana Immigration Service on Tuesday, 8 August 2017.
The same judge had ruled on 31 July 2017 that Mr Dery abused his discretionary power when he deported the businessman without a court order.
Mr Kumar Sivaram’s lawyer, Gary Nimako told the court that his client was not given an opportunity to apply for a visa, thus, his re-entry without one.
The Minister’s deportation order said Mr. Sivaram, acquired and submitted a forged marriage certificate in support of his application for citizenship by registration as a Ghanaian in 2015.
