An Accra High Court has granted the pleas of lawyers of the Electoral Commission (EC) and the All People’s Congress (APC) to make oral submissions on Tuesday, November 1 with regard to the APC’s suit against the EC in which the former is praying the court to compel the election management body to reinstate its flag bearer Mr Hassan Ayariga in the 2016 presidential race.
The judge, Justice Barbara Tetteh Charway, said she will set a date for her judgment after that is done.
Prior to the filing of their oral submissions, the parties are to submit their written statements today, Monday, October 31, following their failure to do so the previous week.
Mr Ayariga was one of 12 other presidential aspirants disqualified from contesting in the elections over alleged illegalities on their nomination forms.
He sought to challenge the decision of the EC in court to have him reinstated arguing that the EC had failed to abide by its own rules.
The court recently overturned the EC’s decision to disqualify Progressive People’s Party flag bearer Dr Papa Kwesi Nduom on Friday, instructing the commission to give him an opportunity to correct anomalies on his nomination form.
It remains to be seen whether the APC could also secure a judgment in its favour. Shortly after the verdict on Dr Nduom’s case, Dr Ayariga indicated that he was glad that “our laws are working”.
On Tuesday after the court ordered the parties to file their submission, Dr Ayariga indicated that he is confident the ruling will go in his favour because he has a better case than the PPP.
“Our case is much better than that of the PPP and I think that God will give us justice. As a political party all we are seeking for is the opportunity to be part of an election and have a presidential candidate for the 2016 elections”.
