The decision of the Electoral Commission (EC) to disqualify some flag bearers from contesting in the December 7 presidential election was “perverse, ultra vires, and fatally flawed”, Kwaku Asare, a US-based Ghanaian professor, has said.
According to him, the EC, just like any other state agency, must learn administrative law in order to avoid this kind of flaws.
Prof Asare’s comment follows the quashing of the EC’s disqualification of Dr Nduom by an Accra High Court on Friday, 28 October.
The court presided over by Justice Eric Kyei Baffour ordered the EC to allow Dr Nduom to effect the necessary corrections on his nomination forms so he could be allowed to be part of the presidential race.
Prof Asare said on his Facebook page that there was an “urgent need for our agencies to sharpen their skills in administrative law”.
